Information
on data processing
3.1 Collection of general information when visiting our website
3.1.1 Type and purpose of processing
When you access our website, i.e. if you do not register or otherwise submit information, information of a general nature is automatically collected. This information (server log files) includes, for example, the type of web browser, the operating system used, the domain name of your internet service provider, your IP address and:
- The type and version of browser used
- the operating system used by the accessing system
- the website from which an accessing system arrives at our website (so-called referrer),
- the sub-websites which are accessed via an accessing system on our website, the date and time of an access to the website,
- an internet protocol address (IP address),
- the Internet service provider of the accessing system.
They are processed for the following purposes:
- Ensuring a smooth connection of the website,
- ensuring the smooth use of our website,
- evaluating system security and stability, and
- to optimise our website.
We do not use your data to draw conclusions about your person. Information of this kind is statistically evaluated by us, if necessary, in order to optimise our website and the technology behind it.
3.1.2 Legal basis and legitimate interest
The processing is carried out in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO on the basis of our legitimate interest in improving the stability and functionality of our website.
3.1.3 Recipients
Recipients of the data may be technical service providers who act as order processors for the operation and maintenance of our website.
3.1.4 Storage period
The data is deleted as soon as it is no longer required for the purpose for which it was collected. This is generally the case for data used to provide the website when the respective session has ended. In the case of storage of data in log files, this is the case after 14 days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are anonymised so that it is no longer possible to assign the calling client.
3.1.5 Provision prescribed or required:
The provision of the aforementioned personal data is neither legally nor contractually required. However, without the IP address, the service and functionality of our website cannot be guaranteed. In addition, individual services and services may not be available or may be restricted. For this reason, an objection is excluded.
3.2 Cookies
Like many other websites, we also use so-called “cookies”. Cookies are small text files that are stored on your end device (laptop, tablet, smartphone or similar) when you visit our website. You can delete individual cookies or the entire cookie inventory. In addition, you will receive information and instructions on how to delete these cookies or block their storage in advance. Depending on the provider of your browser, you will find the necessary information under the following links:
• Mozilla Firefox: https://support.mozilla.org/de/kb/cookies-loeschen-daten-von-websites-entfernen
• Internet Explorer: https://support.microsoft.com/de-de/help/17442/windows-internet-explorer-delete-manage-cookies

• Safari: https://support.apple.com/kb/PH17191?locale=de_DE&viewlocale=de_DE
3.2.1 Storage period and cookies used
If you allow us to use cookies through your browser settings or consent, the following types of cookies may be used on our websites. Cookies are stored by your browser and transmitted by it to our site. Therefore, you as a user also have full control over the use of cookies. By changing the settings in your browser, you can deactivate or restrict the transmission of cookies. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to use all the functions of the website to their full extent.
3.2.2 Technically necessary cookies
3.2.2.1 Type and purpose of processing
We use cookies to make our website more user-friendly. Some elements of our website require that the calling browser can be identified even after a page change. The purpose of using technically necessary cookies is to simplify the use of websites for users. Some functions of our website cannot be offered without the use of cookies. For these, it is necessary that the browser is recognised even after a page change.
We require cookies for the following applications:
- Acceptance of language settings
- Session cookies, which save certain settings of the user (e.g. the shopping basket, language settings or log-in data)
- Flash cookies for the playback of media content
- Cookies that are set by integrated payment service providers (independent of a concrete payment), provided they do not analyse a specific user behaviour, but only serve to prepare possible payments or to check a payment legitimacy
- Opt-out cookies, with which cookie consent can be revoked.
3.2.2.2 Legal basis
The processing is carried out in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO on the basis of our legitimate interest in a user-friendly design of our website.
3.2.2.3 Recipients
Recipients of the data may be technical service providers who act as order processors for the operation and maintenance of our website.
3.2.2.4 Provision prescribed or required
The provision of the aforementioned personal data is not required by law or contract. However, without this data, the service and functionality of our website cannot be guaranteed. In addition, individual services and services may not be available or may be restricted.
3.2.2.5 Objection
Please read the information on your right to object in accordance with Art. 21 DSGVO below.
3.2.3 Technically unnecessary cookies
Furthermore, we use cookies to better tailor the offer on our website to the interests of our visitors or to generally improve it on the basis of statistical evaluations. Please refer to the information below on the display, tracking, remarketing and web analysis technologies used to find out which providers use cookies.
3.2.3.1 Legal basis
The legal basis for this processing is your consent in each case, Art. 6 para. 1 p.1 lit. a DSGVO.
3.2.3.2 Cookie consent tool
Our website uses the cookie consent tool from GDPR Legal Cookie to obtain effective user consent for cookies and cookie-based applications that require consent. Through its integration, users are shown a banner when they access the page, in which consent for certain cookies and/or cookie-based applications can be granted by checking the box. The tool blocks the setting of all cookies requiring consent until the respective user grants the corresponding consent by setting a check mark. This ensures that such cookies are only set on your respective end device if you have given your consent. In order for the cookie consent tool to clearly assign page views to individual users and to individually record, log and store the consent settings you have made for a session duration, certain user information (including the IP address) is collected when our website is called up by the cookie consent tool, transmitted to servers of the provider of the cookie consent tool and stored there. This data processing is carried out in accordance with Art. 6 (1) p. 1 lit. f DSGVO on the basis of our legitimate interest in a legally compliant, user-specific and user-friendly consent management for cookies and thus in a legally compliant design of our website. Further legal basis for the described data processing is Art. 6 para. 1 p. 1 lit.c DSGVO. As the responsible party, we are subject to the legal obligation to make the use of technically unnecessary cookies dependent on the respective user consent. Further information on the use of data by the provider of the cookie consent tool can be found in its privacy policy, available at https://gdpr-legal-cookie.com/pages/datenschutzerklarung. After its initial use/setting, the cookie consent tool can be called up again at any time via a corresponding link “Cookies” on our homepage.
3.2.3.3 Recipients
Recipients of the data may be technical service providers who act as order processors for the operation and maintenance of our website. For further recipients, please refer to the information below on the display, tracking, remarketing and web analysis technologies used.
3.2.3.4 Third country transfer
Please refer to the lists of the individual display, tracking, remarketing and web analysis providers for information on this. Some technologies that we use on our website are offered by US companies. If these technologies are active, your personal data may be transferred to the US servers of the respective provider. We would like to point out that the USA is not a safe third country in the sense of EU data protection law. US companies are obliged to hand over personal data to security authorities without you as a data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.
3.2.3.5 Provision mandatory or required
Of course, you can also view our website without cookies. Web browsers are regularly set to accept cookies. In general, you can deactivate the use of cookies at any time via your browser settings (see Revocation of consent). Please note that individual functions of our website may not work if you have deactivated the use of cookies.
3.2.3.6 Revocation of consent
You can revoke your consent at any time using our cookie consent tool (section 3.2.3.2).
3.3 Profiling
To what extent we analyse the behaviour of website visitors with pseudonymised user profiles, please refer to the information below on the display, tracking, remarketing and web analysis technologies used.

This e-mail contains a link. When you click on this link, you confirm that you would like to receive the newsletter. In this way, we ensure that your e-mail address has not been misused by a third party during registration. 3.4.6 Provision mandatory or required:
The provision of your personal data is voluntary, based solely on your consent. Unfortunately, we cannot send you our newsletter without existing consent.
3.5 Registration on our website
3.5.1 Functionality and scope of data processing
On our website, we offer users the opportunity to register by providing personal data. The data is entered in an input mask and transmitted to us and stored. The data is not passed on to third parties. The following data is collected during the registration process:
- First name
- Surname
- E-mail address
- Adress
The following data is also stored at the time of registration:
- The IP address of the user
- Date and time of registration
- As part of the registration process, the user’s consent to the processing of this data is obtained.
3.5.2 Legal basis for data processing
The legal basis for processing the data is Art. 6 para. 1 p. 1 lit. a DSGVO if the user has given his consent. If the registration serves the fulfilment of a contract to which the user is a party or the implementation of pre-contractual measures, the additional legal basis for the processing of the data is Art. 6 para. 1 lit. b DSGVO.
3.5.3 Purpose of data processing
Registration of the user is necessary for the fulfilment of the purchase contract with the user or for the implementation of corresponding pre-contractual measures.
3.5.4 Duration of storage
The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. This is the case for the data collected during the registration process when the registration on our website is cancelled or modified. This is the case for the data collected during the registration process for the fulfilment of purchase contracts concluded with us for goods or for the implementation of pre-contractual measures when the data is no longer required for the implementation of the purchase contract. Even after the conclusion of the purchase contract, it may be necessary to store personal data of the contractual partner in order to comply with contractual or legal obligations, e.g. our accounting and tax obligations as a seller.
3.5.5 Possibility of objection and removal
As a user, you have the option to cancel your registration at any time. You can have the data stored about you changed at any time. You can have your customer account deactivated by us by sending a corresponding request by e-mail to info@soilytix.com to our customer service. Your customer account will then be deactivated. This process cannot be reversed. You can change your data yourself in your customer account at any time. If the data is required for the fulfilment of a purchase contract with us or for the implementation of pre-contractual measures, premature deletion of the data is only possible insofar as contractual or legal obligations do not prevent deletion.
3.6 Use of our online shop
3.6.1 Processing of the purchase contract
If you wish to place an order in our online shop, it is necessary for the conclusion of the purchase contract that you provide your personal data, which we require for the processing of your order. This also applies, where relevant, to the forwarding of the data required for the processing of your order to payment service providers and, in the case of purchase on account (via the payment service provider), to credit reference agencies for the purpose of creditworthiness enquiries (by the payment service provider). Mandatory data required for the processing of purchase contracts are marked separately, other data are voluntary. We process the data you provide to process your order. For this purpose, we may pass on your payment data to our house bank. The legal basis for this is Art. 6 para. 1 p. 1 lit. b DSGVO.
3.6.2 Customer account
You can voluntarily create a customer account, which allows us to store your data for future purchases (see section 3.5). When you create a customer account, the data you provide will be stored revocably. You can always have us delete all further data, including your customer account, in the customer area.
3.6.3 Self-promotion by email
Technical information: If a contract has been concluded with you, we may also process the data you have provided (irrespective of whether you have given your consent) in order to inform you about other interesting products from our portfolio. The legal basis for this is Art. 6 para. 1 p. 1 lit. f DSGVO and § 7 para. 3 UWG (email self-promotion to existing customers for similar goods and services). You can object to our e-mail self-promotion at any time by sending an e-mail to info@soilytix.com or via the link at the end of the information e-mails. In doing so, you will not incur any costs other than the transmission costs according to the basic rates. Insofar as we send you technical information by email that concerns our online shop, your registration or your purchase, the legal basis for this is Art. 6 para. 1 p. 1 lit. a, b or f DSGVO. You can revoke your consent at any time or object to the sending of technical information at any time as described above.
3.6.4 Storage obligations
Due to commercial and tax law requirements, we are obliged to store your address, payment and order data for a period of ten years. However, we restrict processing after two years, i.e. your data is only used to comply with legal obligations.

3.9 Embedding of YouTube videos with enhanced data protection
We embed YouTube videos on our website. The operator of YouTube is YoutTube LLC, 901 Cherry Ave, San Bruno, CA 94066, USA (hereinafter referred to as “YouTube”). YouTube is a subsidiary of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter referred to as “Google”). We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the disclosure of data to YouTube partners is not necessarily excluded by the extended data protection mode. Thus, regardless of whether you watch a video, YouTube establishes a connection to the Google DoubleClick network. As soon as you start a YouTube video on this website, a connection to the YouTube servers is established. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account. Furthermore, after starting a video, YouTube may save various cookies on your end device or use comparable recognition technologies (e.g. device fingerprinting). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to collect video statistics, improve the user experience and prevent fraud attempts. If necessary, further data processing processes may be triggered after the start of a YouTube video, over which we have no control. YouTube is used in the interest of an appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 (1) sentence 1 lit. f DSGVO. Insofar as a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 p. 1 lit. a DSGVO; the consent can be revoked at any time. Further information on data protection at YouTube can be found in their privacy policy at: https://policies.google.com/privacy?hl=de. Source: https://www.datenschutzerklaerung.de
3.10 Social-Media-Buttons
We offer you the possibility of using so-called social media plug-ins on our website. We currently use the following social media plug-ins: Facebook, Instagram. When you visit our website, no personal data is initially passed on to the providers of the plug-ins. You can recognise the provider of the plug-in via the marking on the box above its initial letter or logo. We give you the opportunity to communicate directly with the provider of the plug-in via the button. Only if you activate the respective social media plug-in via the cookie consent tool and thereby give us your corresponding consent to its use, will the plug-in provider receive the information that you have accessed our website. In addition, the data mentioned in section 3.1 of this declaration will presumably be transmitted to the provider of the plug-in. In the case of Facebook, according to Facebook in Germany, the IP address is anonymised immediately after collection. By activating the plug-in, personal data is therefore transmitted from you to the respective plug-in provider and stored there (in the case of US providers, in the USA). We have no influence on the data collected and data processing procedures, nor are we aware of the full extent of the data collection, the purposes of the processing, the storage periods. We also have no information on the deletion of the collected data by the plug-in provider. The plug-in provider stores the data collected about you as a usage profile and uses this for the purposes of advertising, market research and/or the needs-based design of its website. Such an evaluation is carried out in particular (also for users not logged in to the provider of the plug-in) for the display of needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact the respective plug-in provider to exercise this right. The data transfer to the plug-in provider takes place regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in to the plug-in provider, the data we collect is directly assigned to your account with the plug-in provider. If you click the activated button and, for example, link to the page, the plug-in provider also saves this information in your user account and shares it publicly with your contacts. We recommend that you log out regularly after using a social network, but especially before activating the social media plug-ins, as this will in any case prevent an assignment to your profile with the plug-in provider. By means of the social media plug-ins, we offer the possibility to interact with the social networks and other users so that we can improve our offer and make it more interesting for you as a user. In this respect, the legal basis for the use of the plug-ins is Art. 6 para. 1 p. 1 lit. f DSGVO. Nevertheless, we do not use social media plug-ins without your consent. The legal basis for consent is Art. 6 para. 1 lit. a. DSGVO. Further information on the purpose and scope of the data collection and its processing by the plug-in provider can be found in the data protection declarations of these plug-in providers communicated below. There you will also receive further information on your rights in this regard and setting options for protecting your privacy:
